Why is Spotify not legal to use in a daycare centre?

Because Spotify is licensed for the living room, not the morning circle. The same applies to Apple Music, YouTube Music, Amazon Music and Deezer: all of them allow private, non-commercial use only. Playing them in a daycare counts legally as commercial use — and is prohibited under § 97 of the German Copyright Act (UrhG). The commercial form of unauthorised use is a criminal offence under § 108a UrhG.


The rule also covers personal devices used by educators within the institution. “Anyone who plays music publicly without paying for it is committing a criminal offence,” states attorney Lars Harder-Prinz of media law firm Meinking/Harder-Prinz. “Legally, this constitutes theft from GEMA members and the music creators themselves.”


Roughly eight in ten German daycare centres still play music from Spotify or comparable services — most of them without knowing the law. KIMMA closes the gap.

Typical users: municipal daycare centres, independent providers such as the Fröbel Group, welfare associations such as AWO, faith-based providers and parent-child initiatives. Through provider licences, umbrella organisations can purchase licences in bulk for multiple institutions. The City of Frankfurt uses KIMMA across 150 daycare centres via a framework agreement.

How much does KIMMA cost?

KIMMA is available in three packages. Package S: €20 a month, 3 licences. Package M: €30, 6 licences. Package L: €40, 10 licences. Annual billing cuts the price by 20 percent. One licence per device, smartphone or tablet. All prices exclusive of VAT.
